Pfizer Loses “Wei Ge” Trademark Lawsuit

Following ten years of marathon lawsuit, Beijing High Court ruled against Pfizer in its decision over an appeal by Pfizer to reverse a lower court decision that rejected its request banning the use of the popular Chinese-language name "Wei Ge" for its blockbuster anti-impotence drug Viagra by a competitor. The Beijing No.1 Intermediate Court ruled in favor of the defendent, Guangzhou Wellman Pharmaceutical Co., upholding the trademark registration of ''Wei Ge'' by the company.

Guangzhou Wellman announced on April 8 that Beijing High Court rejected all requests of Pfizer in its final ruling on the ground that evidences supplied by Pfizer can not prove “Wei Ge” was well-known and highly reputable prior to trademark registration of it by the defendant.

Pfizer sells Viagra in China under a registered brand name ''Wan Ai Ke,'' but argued that Viagra also is known as ''Wei Ge,'' or ''Mighty Brother,'' and other companies should be barred from using that name.

Guangzhou Wellman, which now has the final victory, offered to share the use of “Wei Ge” trademark with Pfizer and said it is flexible with the ways of cooperation. The company said the biggest problem facing both Pfizer and itself is counterfeit drugs, and it is willing to work with Pfizer in fighting counterfeit drugs.
